The User Manual, supplied with the Device, forms part of the contractual information.
The Privacy Policy, a standalone document, describes the processing of personal data.
Mandatory consumer protection. No provision of these Terms may deprive the consumer Customer of any right granted to them on a mandatory basis by law.
ARTICLE 3 — DEFINITIONS
Customer: the adult natural person, acting for purposes outside their trade or profession, who places an order.
Complete Neuro+ System: the single offer marketed by Neuro+, comprising the Device and the Accompaniment, which are indivisible.
Device: the Neuro+ photobiomodulation headset, model NP-H1-P1, its power adapter and accessories.
Accompaniment: the assistance service relating to the use and configuration of the Device, governed by the Accompaniment Terms.
Beneficiary: the person on whom the Device is used.
ARTICLE 4 — THE PRODUCT
4.1 Description
The Device is a photobiomodulation headset emitting low-intensity near-infrared light at the forehead, intended for wellness use at home.
Model: NP-H1-P1. Manufactured in France by Neuro+ SAS.
Power supply: 12 V DC, via the external power adapter supplied (input 100–240 V, 50/60 Hz).
The housing is placed directly on the skin of the forehead. The LEDs are set back inside the housing, approximately 1 cm from the skin. The housing acts as a screen: no light is visible during use.
4.2 Conformity
The Device bears the CE marking and complies with Directive 2014/30/EU on electromagnetic compatibility and Directive 2011/65/EU on the restriction of hazardous substances.
Testing was carried out by an independent third-party laboratory in accordance with standards EN 61000-6-1, EN 61000-6-3 and EN 62368-1.
For the United States, the Device complies with Part 15 of the FCC Rules.
The EU Declaration of Conformity is available on request at hello@myneuroplus.com.
4.3 Safety information
The Device must not be used on a child under 4 years of age.
Use by a minor must take place under the direct and continuous supervision of an adult.
Maximum session durations:
| Age of the Beneficiary | Maximum duration |
|---|---|
| Under 4 years | Use not permitted |
| 4 to 10 years | 5 minutes |
| 11 to 16 years | 10 minutes |
| Over 16 years | 15 minutes |
Do not look directly at the LEDs while the Device is operating. This light is barely visible or invisible: its invisibility does not mean there is no emission.
Contraindications. The Device must not be used in cases of photosensitive epilepsy or a history of light-induced seizure; a wound, lesion, burn, eczema or irritation on the forehead area; ongoing photosensitising treatment; a recent tattoo or recent dermatological treatment on the forehead; a medical implant in the head area, unless advised otherwise by a healthcare professional; or a feverish or acute infectious state.
In case of doubt, seek the advice of a healthcare professional before use.
All safety instructions are set out in the User Manual, which may be consulted before purchase at myneuroplus.com.
4.4 Settings
The power of the Device is set by Neuro+ before shipping, on the basis of non-medical criteria: the Beneficiary's skin phototype, age, morphology and declared sensory sensitivity. This setting must not be modified by the Customer.
The Device is not made to the Customer's specifications: the setting is adjustable and does not affect the possibility of returning the Device to circulation.
4.5 Spare parts and repair
Spare parts are not sold separately to consumers.
Neuro+ provides a repair or standard exchange service for the Device during the commercial warranty period referred to in Article 12, subject to component availability.
ARTICLE 5 — PRICE
5.1 Price of the Complete System
The Complete Neuro+ System is offered at the price of EUR 1,599 including tax, comprising:
- the Device: EUR 1,350 including tax;
- the Accompaniment: EUR 249 including tax.
The Device and the Accompaniment are not sold separately.
Prices are stated inclusive of all taxes, in euros.
5.2 Delivery charges
- France and European Union: free delivery.
- Other destinations: charges calculated automatically according to destination and displayed before the order is confirmed.
5.3 Customs duties
For deliveries outside the European Union, any customs duties, import taxes and clearance fees are payable by the Customer and are not included in the price. The Customer is the importer under the customs regulations of their country.
5.4 Price changes
Neuro+ may change its prices at any time. The applicable price is the one displayed at the time the order is confirmed.
5.5 Price reductions
Where a price reduction is announced, the reference price indicated is the lowest price applied by Neuro+ during the thirty days preceding the announcement.
ARTICLE 6 — ORDERS
6.1 Online orders
The Customer selects the Complete System, checks the details of the order and its total price, provides the information required for delivery, reads and accepts these Terms by a positive action, and then confirms the order.
Confirmation is made using a button bearing an unambiguous statement of the obligation to pay.
Confirmation of the order constitutes acceptance of these Terms of Sale.
6.2 Orders by quotation
The Customer receives a quotation accompanied by these Terms of Sale, the Terms of Use of the Service, the Accompaniment Terms and the withdrawal form.
A quotation signed by the Customer constitutes an order and acceptance of those documents, whose version and date are stated on the quotation.
6.3 Confirmation
Neuro+ sends the Customer, by email, an order confirmation accompanied by these Terms in the applicable version, on a durable medium.
6.4 Refusal of an order
Neuro+ may refuse an order on legitimate grounds, in particular unavailability, an unresolved earlier dispute, suspected fraud, or an order manifestly intended for resale. The Customer is informed and refunded in full where applicable.
ARTICLE 7 — PAYMENT
7.1 Payment methods
Bank card, PayPal, Klarna and interest-free payment in three instalments offered by these providers. Bank transfer for orders placed by quotation.
7.2 When payment is due
Payment is due when the order is placed.
7.3 Instalment payment
Interest-free payment in three instalments is offered and managed by a third-party provider. It is subject to that provider's own terms, to which the Customer agrees directly. Neuro+ is not a party to that relationship.
7.4 Security
Payment data is processed directly by the payment providers. Neuro+ has no access to bank card numbers and does not store them.
ARTICLE 8 — DELIVERY
8.1 Areas and carriers
- European Union and United Kingdom: delivery by UPS.
- United States, Israel, Australia: delivery by DHL.
8.2 Timescales
| Destination | Indicative time from dispatch |
|---|---|
| France and European Union | approximately 5 working days |
| Outside the European Union | generally less than 10 working days |
These timescales are indicative. Timescales outside the European Union may be extended by customs formalities, which are beyond the control of Neuro+.
8.3 Delivery deadline
Neuro+ undertakes to deliver the Device within a maximum of thirty days from the conclusion of the contract.
8.4 Late delivery
If the deadline is exceeded, the Customer may require Neuro+ to deliver within a reasonable additional period. Failing performance within that period, the Customer may terminate the contract by registered letter or in writing on a durable medium.
The contract is deemed terminated upon receipt of that notice, unless delivery has taken place in the meantime. Neuro+ then refunds all sums paid, at the latest within fourteen days of termination.
8.5 Receipt
The Customer should check the condition of the parcel on delivery. Where damage is apparent, we recommend recording reservations with the carrier and informing Neuro+.
The absence of reservations does not deprive the Customer of any right, in particular under the legal guarantees.
8.6 Transfer of risk
The risk of loss of or damage to the Device passes to the Customer at the moment they take physical possession of the Device.
ARTICLE 9 — RIGHT OF WITHDRAWAL
9.1 Principle
The Customer has a period of fourteen days to exercise their right of withdrawal without giving reasons and without bearing costs other than those set out in Article 9.5.
9.2 Starting point
- For the Device: from the day of receipt.
- For the Accompaniment: from the day the contract is concluded.
9.3 Exercise
The Customer notifies their decision by any unambiguous statement, sent to hello@myneuroplus.com or by post to 4 rue des Côtes, 28000 Chartres. They may use the model form annexed to these Terms, but are not obliged to.
9.4 Return
The Customer returns the Device no later than fourteen days after communicating their decision, to the address given in Article 9.3.
9.5 Costs
The direct costs of returning the Device are borne by the Customer.
9.6 Refund
Neuro+ refunds all sums paid, including the initial delivery costs at the standard delivery rate, at the latest fourteen days from the date on which Neuro+ is informed of the decision to withdraw.
Neuro+ may withhold the refund until the Device has been recovered or until the Customer has provided evidence of having dispatched it, whichever is the earlier.
The refund is made using the same means of payment as the order, unless the Customer expressly agrees to another means.
9.7 Diminished value
The Customer is liable only for any diminished value of the Device resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
Simply trying the Device, including wearing it on the forehead and using it in accordance with the User Manual, does not constitute excessive handling and gives rise to no deduction.
9.8 Start of the Accompaniment
The Accompaniment is considered to have started once the first personalized support interaction between the Customer and the Neuro+ team has taken place after delivery of the Device.
In the event of withdrawal within the statutory fourteen-day period, the Customer is refunded the entire price of the Complete System, including the portion corresponding to the Accompaniment, with no deduction for services already provided.
9.9 Exceptions
The Device is not made to the Customer's specifications within the meaning of Article L221-28, 3° of the French Consumer Code: the setting made before shipping is adjustable and does not prevent the Device from being returned to circulation.
Neuro+ does not rely on the exception relating to sealed goods on hygiene grounds, subject to Article 10.5 concerning Devices returned in a sanitary condition preventing any return to circulation.
ARTICLE 10 — 60-DAY SATISFACTION GUARANTEE
10.1 Nature
Independently of the legal right of withdrawal set out in Article 9, Neuro+ grants the Customer a commercial satisfaction guarantee.
This commercial guarantee is in addition to, and does not replace, the Customer's legal rights. It affects neither the right of withdrawal, nor the legal guarantee of conformity, nor the guarantee against hidden defects.
10.2 Duration and conditions
The Customer has sixty days from receipt of the Device to request a return if not satisfied.
The Customer must contact Neuro+ at hello@myneuroplus.com to receive return instructions.
The Device must be postmarked no later than the sixtieth day after delivery. The dispatch date governs; the date Neuro+ receives the return does not determine compliance with the sixty-day period.
From day 1 to day 14, the statutory right of withdrawal applies as described in Article 9.
From day 15 to day 60, this commercial guarantee applies:
- return by tracked parcel;
- the parcel must be insured for the value of the Device;
- return shipping, insurance and any costs associated with return customs formalities are borne by the Customer;
- original shipping charges, customs duties, import taxes, brokerage fees and other amounts paid directly to authorities are not refunded under this commercial guarantee;
- the schedule in Article 10.4 applies in the event of damage.
10.3 Refund
From day 15 to day 60, the refund amount attributable to the Device is €1,125, corresponding to its reference value excluding tax, or the equivalent amount in the currency used for the order.
If the Accompaniment has not started as defined in Article 9.8, the portion corresponding to the Accompaniment is also refunded. Its reference value is €249 including tax, or the equivalent amount in the currency used for the order.
Once the Accompaniment has started, that portion is non-refundable under this commercial guarantee.
Any deductions under Article 10.4 are applied to the refund amount attributable to the Device.
Subject to those deductions, Neuro+ processes the refund within 10 days after receiving and inspecting the returned Device.
The refund is made using the same payment method as the order, unless Neuro+ and the Customer agree otherwise.
10.4 Condition of the Device on return
The Customer undertakes to return the Device in a normal state of cleanliness, after cleaning in accordance with the maintenance instructions in the User Manual.
From day 15 to day 60, the following schedule applies:
| Condition observed | Deduction |
|---|---|
| Normal signs of use, superficial scratches | None |
| Light soiling that can be cleaned | None |
| Missing accessory or cable | Price of the part |
| Cracked, marked or damaged housing, Device functional | 30% |
| One or more LEDs out of order, Device partially functional | 60% |
| Device no longer functioning, immersed, opened or modified | 100% |
Procedural safeguards. Before any deduction, Neuro+ sends the Customer photographs of the Device as received. The Customer may contest the deduction and refer the matter to the mediator named in Article 16.
Damage occurring during return transport gives rise to no deduction when covered by the return transport insurance taken out by the Customer.
10.5 Sanitary condition
A returned Device presenting ingrained organic soiling, persistent food residues, lingering odours despite cleaning, or parasitic contamination cannot, for reasons of sanitary safety, be returned to circulation or given back.
It is destroyed and its full value remains payable. Neuro+ documents this destruction and informs the Customer, with photographic evidence.
This provision applies whatever the date of return, including during the legal withdrawal period, the Device then being permanently unfit to be placed on the market.
ARTICLE 11 — LEGAL GUARANTEES
11.1 Legal guarantee of conformity
Neuro+ is liable for lack of conformity of the Device under Articles L217-3 et seq. of the French Consumer Code.
The Customer has two years from delivery to bring a claim. They may choose between repair and replacement, subject to the cost conditions provided by law. They are not required to prove the existence of the defect during the twenty-four months following delivery.
Bringing the Device into conformity is carried out at no cost to the Customer and without major inconvenience, having regard to the nature of the Device and the intended use.
The Customer may obtain a price reduction while keeping the Device, or termination of the contract with a full refund, in the cases provided by law.
Where repair or replacement immobilises the Device for at least seven days, the guarantee period is extended accordingly.
11.2 Guarantee against hidden defects
The Customer may also rely on the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code, within two years of discovering the defect and no more than twenty years from delivery. They may then choose between rescission of the sale and a reduction in price.
11.3 How to claim
Any claim under the legal guarantees should be sent to hello@myneuroplus.com or to 4 rue des Côtes, 28000 Chartres.
ARTICLE 12 — COMMERCIAL WARRANTY ON THE DEVICE
Neuro+ grants a commercial warranty of two years from delivery, covering defects in materials and workmanship under normal conditions of use.
How it works. Neuro+ repairs the Device where repair is possible. Where it is not, Neuro+ provides a standard exchange. This commercial warranty does not give rise to a refund.
Exclusions. Use not in accordance with the User Manual, modification of the Device, accidental damage, repairs carried out by a third party and normal wear are excluded.
This commercial warranty is in addition to, and does not replace, the legal guarantees referred to in Article 11. It in no way affects the rights the Customer derives from those legal guarantees.
ARTICLE 13 — RETENTION OF TITLE
Neuro+ retains ownership of the Device until the price has been paid in full. This retention does not affect the transfer of risk provided for in Article 8.6.
ARTICLE 14 — LIABILITY
Neuro+ is liable as of right for the proper performance of its contractual obligations, under Article L221-15 of the French Consumer Code.
Neuro+ may be relieved of all or part of its liability by proving that the non-performance is attributable to the Customer, to an unforeseeable and insurmountable act of a third party unconnected with the contract, or to force majeure.
Neuro+ does not limit or exclude its liability in the event of personal injury, death, gross negligence or wilful misconduct, nor in any other case where the law prohibits it from doing so.
The Customer is responsible for complying with the User Manual, for supervising the Beneficiary during sessions, and for the accuracy of the information they provide.
ARTICLE 15 — PERSONAL DATA
The processing of the Customer's and the Beneficiary's personal data is described in the Privacy Policy.
Health data concerning the Beneficiary is subject to explicit consent, separate from acceptance of these Terms and obtained purpose by purpose. That consent may be withdrawn at any time.
Refusing optional purposes has no effect on the supply of the Complete System.
ARTICLE 16 — COMPLAINTS AND MEDIATION
16.1 Prior complaint
Any complaint should be sent to hello@myneuroplus.com or by post to 4 rue des Côtes, 28000 Chartres.
16.2 Consumer mediation
Under Article L612-1 of the French Consumer Code, the Customer may use free of charge the consumer mediator appointed by Neuro+, after sending a written complaint to Neuro+ and failing a satisfactory reply within one year of that complaint:
CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice
49 rue de Ponthieu, 75008 Paris, France
Telephone: +33 1 89 47 00 14
Email: litiges@cm2c.net
Website: https://www.cm2c.net/declarer-un-litige.php
Recourse to mediation is optional. It does not prevent the Customer from bringing proceedings before the competent court at any time.
ARTICLE 17 — RECYCLING OF ELECTRICAL EQUIPMENT
The Device falls within the regulations applicable to waste electrical and electronic equipment. It must not be disposed of with household waste, but taken to an appropriate collection point.
On purchase, the Customer may request free take-back of an equivalent item of used equipment, by writing to hello@myneuroplus.com.
An eco-contribution intended to fund collection and treatment is included in the price and identified on the invoice.
ARTICLE 18 — CHANGES TO THESE TERMS
Neuro+ may amend these Terms. The Terms applicable to an order are those in force and accepted on the day of the order. No subsequent amendment is enforceable against the Customer in respect of an order already concluded.
ARTICLE 19 — MISCELLANEOUS
Partial invalidity. If any provision is held to be void or unenforceable, the remaining provisions continue in force.
No waiver. The fact that Neuro+ does not rely on a provision does not constitute a waiver of that provision.
Language. These Terms were drawn up in French. In the event of translation, the French version prevails between the parties, without prejudice to the Customer's right to obtain contractual information in the language of their country of residence where the law so requires.
Archiving. Neuro+ retains the version of the Terms accepted by the Customer and the record of that acceptance.
ARTICLE 20 — GOVERNING LAW AND JURISDICTION
These Terms are governed by French law.
This provision does not deprive a consumer Customer residing in another Member State of the European Union of the protection afforded by the mandatory provisions of the law of their habitual residence.
The Customer may bring proceedings, at their choice, before the court of their place of residence or that of the registered office of Neuro+.
